EU Firearms Proposals

Thank you for writing to Mr Etheridge on this issue. The Commission proposal has recently passed a vote in the IMCO committee despite the attempts from UKIP MEP’s to block it. This now means that the proposal is currently in trialogue negotiations between the Parliament, the Commission and the Council before a final text is voted on in parliament.

We have received many emails and letters of concern regarding this proposal and I would like to briefly outline the main issues that UKIP have with this proposal.

Firstly, the weapons used in the Paris atrocity, and more generally the weapons used in most terrorist attacks, are illegally-held weapons. Changing the law on gun ownership is therefore unlikely to have any significant impact on the availability of weapons to terrorists. Indeed the EU is clearly the problem, not the solution. There is extensive evidence that for example Croatia, which recently joined the EU, is a hotbed of smuggling – not only of arms, but also of money, drugs, people and even human organs. It has been said (and it is no exaggeration) that free movement of goods and people in the EU (and especially the Schengen area) has led to free movement of Kalashnikovs.

The problem is not that we have too little regulation, but that we are failing to implement the legislation we already have.

Secondly, so far as we understand it the UK already has some of the tightest firearms regulation in the world and this is confirmed in various statements from the Home Office. We do not believe that further legislation at EU level will make any additional contribution to public safety. In any case we in UKIP are opposed in principle to any extension of competences at the EU level.

I can therefore confirm that UKIP MEP’s have, and will continue to, oppose the new EU Firearms proposal. Sadly, however, I fear it will be approved anyway. There is nothing most MEPs like more than a nice piece of gesture politics in response to public concern – whether or not their gesture has any practical effect. But the proposals are being driven forward by the unelected EU Commission which is desperate to distract people from the consequences of freedom of movement.

also im Video ist die Vicky schon sehr von sich und ihrer Arbeit überzeugt

dass das der Komission und dem Rat wurscht ist versteht sie aber nicht so recht glaub ich
das Parlament ist mehr ein Hindernis als ein Werkzeug in diesem Fall

Naja, sie stützt sich halt auf den damals chaotischen IMCO vote ... die nimmt den Quatsch von den Compromise Amendments halt als gottgegeben an und will sich jetzt nicht mehr wirklich bewegen, obwohl sie vielleicht auch später "erleuchtet" wurde ...

Wir werden jedenfalls mehr "Red Tape" bekommen, wenn der Quatsch durchgeht. Soviel ist klar.

"Certain semiautomatic firearms when fitted with high capacity magazines are to be treated as Kat. A prohibited firearms, but with special permissions for sport shooters" das kann man jetzt auch wieder deuten wie man mag. Fitted heißt aber für mich eingebaut oder montiert (bzw. angesteckt). Dh. wenns nach dem geht, gibt es keinen Magazin Ban. Glaub ich aber erst, wenns soweit is.

Außerdem soll es für die Kat. B7 bzw. die umgebauten Vollautomaten eine Grandfathering Regel geben, mit der Option zum Weiterverkauf, vererben etc.

Da is noch so vieles offen und die Kommission werkt natürlich auch im Hintergrund herum ...

herzlichen Dank für Ihr Schreiben. Eingangs möchte ich mein Mitgefühl gegenüber den Opfern und deren Angehörigen der Terrorangriffen (Frankreich, Tunesien, Russland, Türkei) zum Ausdruck bringen. Andererseits kann ich den Grad der Verachtung, die ich Menschen entgegenbringe, die solches Leid über andere Menschen bringen, gar nicht mit Worten beschreiben. Auf allen
Ebenen – international, europaweit und national – muss alles unternommen werden, um dieser Bedrohung Herr zu werden. Jene Terroristen, die unsere Gesellschaft in Angst und Schrecken versetzen und letztendlich unsere Freiheit abschaffen und unsere Demokratien zerstören wollen, müssen gefasst und zur Rechenschaft gezogen werden. Vor diesem Hintergrund hat die Europäische Kommission vorgeschlagen, die Richtlinie über die Kontrolle des Erwerbs und des Besitzes von Waffen zu verschärfen. Geplant ist unter anderem, die Regelungen betreffend Deaktivierung, Waffenhändler, Makler und Markierung von Schusswaffen zu präzisieren und zu ergänzen. Darüber hinaus sind Veränderung hinsichtlich der Kategorisierung von Feuerwaffen geplant.

Ich unterstütze jede effiziente Maßnahme, die zur Verhinderung des illegalen Erwerbs und der illegalen Nutzung von Schusswaffen dient. Maßnahmen, die legale Waffenbesitzer wie etwa Jäger, Traditions- oder Sportschützen kategorisch unter den Generalverdacht stellen, von Ihnen ginge eine terroristische oder kriminelle Gefahr aus, lehne ich jedoch ausdrücklich ab. Meines Erachtens sind die derzeit in Österreich bestehenden gesetzlichen Vorschriften betreffend Handel, Besitz und die Verwendung von Waffen angemessen, um eine unrechtmäßige Verwendung von Waffen weitestgehend ausschließen zu können. Dies beweist auch der Umstand, dass kaum ein Verbrechen oder ein Unfall in Österreich mit legal erworbenen oder besessenen Waffen passiert.

Auch das Bundesministerium für Inneres hat – wie viele andere europäische Staaten
auch – ebenfalls eine sehr kritische Haltung zu einzelnen Vorschlägen der Europäischen Kommission eingenommen. Erklärtes Ziel ist es, bei den derzeitigen Trilog-Verhandlungen sicherzustellen, dass das bestehende österreichische Waffenrecht im Ergebnis soweit wie möglich unverändert belassen werden kann. Insbesondere wurde der Vorschlag der Europäischen Kommission, halbautomatische zivile Schusswaffen, die wie vollautomatische Kriegswaffen aussehen, in die Kategorie der verbotenen Waffen aufzunehmen, von Österreich und der überwiegenden Mehrheit an Mitgliedstaaten abgelehnt.

Die konkreten Umsetzungsschritte können aber erst dann festgelegt werden, wenn der endgültige Text der geänderten Richtlinie feststeht. Es darf aber nochmals versichert werden, dass sich das Bundesministerium für Inneres – das hat mir Herr Bundesminister Sobotka bestätigt – bei den Verhandlungen in Brüssel dafür einsetzt, dass ein verantwortungsvoller Umgang mit und der Zugang zu Waffen, insbesondere für Jäger und Sportschützen, auch in Zukunft jedenfalls gewährleistet sein muss.

Schließlich darf ich in diesem Zusammenhang auf die vom EU-Ausschuss des Bundesrates am 11. Mai 2016 beschlossene Mitteilung (https://www.parlament.gv.at/PAKT/VHG/BR ... ndex.shtml) an das Europäische Parlament, den Rat und die Europäische Kommission verweisen.

Auszugsweise, startet ca bei 1:27:00 die Aussagen von Evelyne Gebhardt (SPD).

kurz zusammengefasst:

Sie ist über die Kat A7 Regel nicht zufrieden. Aber es müssen Mehrheitsentscheidungen akzeptiert werden. Es wäre ihr lieber wenn alle diese schlimmeren Waffen weg vom Fenster wären. Bestandsschutz ist wichtig -> sonst ev. illegale Waffen und zuletzt - das muss man sich auf der Zunge zergehen lassen:

Deshalb sollen ab einem gewissen Zeitpunkt keine neuen Waffen auf den Markt gebracht werden dürfen und verkauft werden dürfen! Das findet sie in Ordnung und richtig so.

@Incite: Was erwartest du von den Roten? Cofferati hat ja auch die ganze Zeit in die "ban more" Richtung gepusht ... ich schätze, dass er und die Grünen maßgeblich daran beteiligt waren, dass die Compromise Amendments vom IMCO so nahe am Ratsbeschluss sind.

Andererseits: Was micht wundet ist, dass TROTZ der Ähnlichkeit von IMCO Beschluss/Kompromiss und Ratsbeschluss sich die Verhandlungen im Trilog trotzdem so ziehen. Die sind ja fast Zwillinge gewesen, von Kleinigkeiten mal abgesehen ...

Wenn's nach mir geht, müssen die sich auf gar nichts einigen ...

ich habe schon viel gelesen, aber, dass ab einem gewissen Zeitpunkt keine Neuwaffen mehr verkauft werden dürfen - so konkret habe ich das noch nicht gehört.

Auch ein Bestandsschutz lässt mich besser schlafen.

Über die Farben sage ich nichts mehr. Wurde hier ja schon alles gesagt. Ich unterstütze keine Entwaffner (von Legalwaffen). Wenn Verbrechern die Waffen entzogen werden - das unterstütze ich natürlich.

The third trilogue on the Firearms Directive took place on 15 November. The fourth trilogue is agreed for 5 December. This is a normal and expected procedure.

There is a great deal of similarity between the Council and the Parliament. The Parliament is demanding our key positions are met.

Regarding Category A

The Council and Parliament texts both agree that certain semi-automatic firearms when fitted with high capacity magazines are to be treated as Category A prohibited firearms but with special permissions for sport shooters.

There is agreement between the Commission, Council and Parliament that the exemption for sport shooters must work not just on paper but also in practice. The Parliament is pressing for this and we are making progress. Any concerns on the practical implementation of this exemption can be addressed to the Director in DG Grow of the European Commission.

Regarding Annexes, both the European Parliament and the Council have firmly rejected the Commission’s original language on resemblance. We will not accept prohibiting items based on what they look like rather than what they are.

Further discussion is required on the issue of semi-automatics converted from automatics, the Parliament have restated their desire to try and find a solution that is workable for the responsible legal shooting community and there is support from the Council for grandfathering in order to ensure existing legal holders can continue to hold their firearms. The EP is also pressing for an agreement where these firearms can be transferred, inherited and sold.

The Commission have said they are not prepared to accept responsibility for technical specifications on conversions of automatic to semi-automatic firearms under Article 10ba and the Council does not want this.

Deactivated Firearms

It is important that deactivation of firearms should be irreversible and ensure the firearm is inoperable. The European Deactivation Regulation introduced in April 2016 sets a single standard for deactivation but has raised many practical issues for legitimate holders of these items, including reenactors.

There is now a clearer understanding by the Council and the Commission of the issues faced by legitimate holders of these items and progress is being made on resolving implementing issues in the Deactivation Regulation. The Parliament is clear that the Expert Working Group on the Deactivation Regulation must have completed their work by early 2017.

Regarding deactivations before April 2016, the Parliament position is that firearms deactivated to an equivalent previous standard should still be able to be bought and sold and Parliament suggests that national deactivation standards which are equivalent to the aims of the new EU standard adopted should be recognised as such. The Commission have now taken this concern on board and are working on new language to enable this.

It is clear that the Commission will not be prepared to just rubber stamp all old deactivation standards so it will be up to each Member State to make the case for deactivations undertaken according to their previous system and the Commission to then approve on a case by case basis.

Authorisations
We are making good progress on agreeing language for special authorisations for reservists and other specialist needs - although this is not yet finalised.

The Parliament is pressing for its language for member states to have monitoring systems, which includes the assessment of relevant medical and psychological information in accordance with national law, and which may be on a continuous or non-continuous basis.

European Firearms Pass
The Council has agreed to include Category A weapons in the European Firearms Pass when holders have authorisations for them. This will improve the implementation of the pass.

We are all dedicating significant time towards finalising a text which works for legal holders of firearms and also addresses those loopholes and inconsistencies which have existed in the past.

Hatten wir schon ein paar Beiträge weiter vorher...es bringt auch nichts hier dieselben Antworten von wem auch immer immer wieder und wieder zu posten.
